New Florida SAFE Act Aims to Protect Drivers with Disabilities During Traffic Stops

Florida has introduced a groundbreaking law designed to improve safety and understanding during interactions between law enforcement and drivers with disabilities. The Safeguarding American Families Everywhere (SAFE) Act, signed by Governor Ron DeSantis, allows Floridians to voluntarily indicate disabilities or medical conditions on their driving record. What is the SAFE Act?

Starting October 1, 2024, the SAFE Act (House Bill 341), sponsored by Tallahassee Representative Allison Tant, will enable drivers or their guardians to include a “SAFE” designation in the Department of Highway Safety and Motor Vehicles (DHSMV) system. This designation informs officers that someone in the vehicle may have a condition that could affect how they respond to commands or requests during an interaction.

“There’s someone in the vehicle who may not respond to commands or requests by those officers in the way they’re accustomed to.”

This proactive measure aims to protect individuals with disabilities and promote awareness among law enforcement officers.

How it Works

Drivers or parents/guardians of individuals with disabilities can indicate their medical conditions during the motor vehicle registration process. The “SAFE” designation will appear in the DHSMV system and can be removed at any time upon request.
